Cadillac diminished value claims

If another driver damaged your Cadillac in Texas, their insurer owes you more than the repair bill. It owes you what the collision history took off the car's value.

Why a collision record hits a Cadillac hard

High-trim Escalades are among the most common luxury vehicles on Texas roads, and among the most common diminished value claims. Blackwing sedans are collector-grade and lose disproportionate value from a reported collision.

Diminished value is measured as a share of the vehicle's pre-accident market value, so the same fender-bender that costs a mainstream sedan a few thousand dollars can cost a Cadillac owner a five-figure sum. The at-fault driver's insurer rarely mentions it, and when pressed, offers a formula number that bears no relation to what the market actually does.

Models we commonly see

Escalade and Escalade-V, CT5-V Blackwing, Lyriq, and Celestiq. The list is not exhaustive; if the vehicle is a Cadillac, we want to see it.

What the claim looks like

  • Inherent diminished value: the loss from the accident appearing on CARFAX, AutoCheck and dealer systems, measured by an independent appraiser using comparable sales for your model.
  • Repair-related diminished value: additional loss where the repair was done without manufacturer certification, with non-OEM parts, or with structural work that does not meet factory specification.
  • Loss of use: the reasonable rental value of a comparable vehicle for the period repairs reasonably took, not the economy rental the adjuster offered. Loss of use details.

Texas rules that apply

  • The claim is against the at-fault driver and their liability insurer. Your own insurer generally does not owe diminished value under a standard Texas policy.
  • You have two years from the collision to file suit.
  • Recovery is reduced by any percentage of fault assigned to you.

Our fee

One-third of the recovery if the claim resolves without a lawsuit, 40% if we have to file. Nothing up front, and no attorney's fee unless we recover. Fee details.

Before you accept anything from the insurer: do not sign a release or cash a diminished value check until we have reviewed the claim. A small formula-based payment is often framed as full settlement.
