Diminished value claims in Sugar Land
Sugar Land, Riverstone and Sienna have deep luxury-vehicle ownership, and US-59 and Highway 6 carry heavy commuter traffic into Houston.
When one of those collisions damages a late-model luxury, exotic or performance vehicle, the owner is usually entitled to recover far more than the repair invoice from the at-fault driver's insurer: the diminished value of the vehicle after repair and the loss of its use while in the shop. Texas law supports both claims. Insurers pay them when the claim is documented by an independent appraisal and presented by a firm that files suit.
Texas rules that govern a Sugar Land claim
- Third-party claim. The claim is against the at-fault driver and their liability carrier. Your own insurer generally does not owe diminished value under a standard Texas policy.
- Two-year deadline. Suit on a property damage claim must be filed within two years of the collision.
- Proportionate responsibility. Recovery is reduced by any share of fault assigned to you, and barred if your share exceeds 50%.
- Where suit is filed. If the insurer refuses to pay, the lawsuit against the at-fault driver is generally filed in Fort Bend County or the county where the driver lives.
